Open Violations Can Prevent An Owner From Selling Or Refinancing.

My Property Has An Open Violation Against It. How Can I Clear This Up?

The NYC Construction Codes require owners to build and maintain their properties in safe condition. Inspectors issue Environmental Control Board (ECB) Notices of Violation or Department of Buildings (DOB) violations when property or construction doesn't comply with the Construction Codes, NYC Zoning Resolution and other applicable laws and rules.

The NYC Construction Codes 要求業主在安全條件下建造和維護他們的房產或物业。當物业或建築不符合建築規範、紐約市分區決議和其他適用的法律和規則時,檢查員會發出環境控制委員會 (ECB) 違規通知或房屋局 (DOB) 違規通知。

 

The requirements for clearing up a violation will depend on its details. For information on resolving a violation issued by Departments, or the hearing process for violations that were or will be heard before the Environmental Control Board (ECB), please contact us.

For example, if your property is not validly registered, you cannot apply for any violation removal processes.

Registration is required annually for,若您的房产有以下情况,则需要每年报告登记, 我们会先为您办理房产登记,再进行违规消除。

All multiple dwellings (buildings with three or more residential units). This includes condominium buildings (not units), cooperatives, and hotels. 所有多戶住宅(建築物内具有三個或三个以上住家單元),包括Condo(不是單元)、Co-op和酒店;

One and two family homes only if neither the owner nor any family member lives there.

单個和兩家庭的住宅建筑——只有当業主或任何家庭成員都沒有住在那裡的情況下,需要每年登记。

Resolving ECB Violations

There are three classes of ECB Notice of Violations:

Class 1 -- Immediately Hazardous - 政府会不断地来开出、重复的违规(若不更正)

Class 2 -- Major -  一次性罚单

Class 3 -- Lesser.

The ECB Notice of Violation (NOV) contains the Property/ Respondent Information, an order to correct the violating condition, Violation Cure and Hearing Information, Cure Date, Hearing Information, and to certify correction at the Department of Buildings.

ECB 違規通知包含相关房產/答辯人信息、需要糾正所属違規情況的命令、違規處理和聽證信息、违规纠正日期、聽證日期及信息,並在建築部證明相关更正事项。 ​​​

Owners who do not attend the hearing or don't have a representative may face default penalties up to $ 25,000 depending upon the violation.

若业主或其代表不出席听证会,業主可能會面臨高達 25,000 美元的違約罰款,具體取決於違規行為。

We would cure the problem and submit a certificate of correction (AEU-2 form) to the Department's Administrative Enforcement Unit and certify that the violation has been corrected, with attend an ECB hearing, or non-hearing options.

J&R Consulting Service 处理 Summons / Commissioner's Order 罚单的步骤说明如下:

-       Hearing Date: 上法庭日

-       Cure Date: 改正现状的日期 - 如果有这个日期,可以在此日期之前进行更正就不需要上庭,则ECB罚款可以减除。

                                如果不能完成更正现状,则必须在上庭日出庭,而且会有罚款。

                                *** DOB的罚款则是不可以避免的。

罚款项目:

     商业楼 (Commercial Buildings)& 四家庭(含)以上,每张罚单金额 $5,000.00;

     住家楼(Residential Buildings)(包括:1、2、3家庭);

Infraction Code - 违规种类;

Provision of Law - 规定法规种类

Dept of Housing Preservation & Development - Overdue Violations

Options depend upon the issue dates of the violations. If the violations are overdue, which means that the violations remain on the record past the certification date with no valid certification submitted.

Dismissal Request

If the property has violations issued within the past 12 months that were not timely certified, filing for a Dismissal Request is the only process for violation removal. Only a registered owner/agent or authorized representative can file a Dismissal Request.

如若被委托建筑的違規行為在過去 12 個月內未得到及時認證解决,則只能通过提交 Dismissal Request 来消除違規。 只有由註冊的所有者/代理人或通过授權代表可以向住房保护与开发局提出 Dismissal Request。

Violation Reissuance

If there are no violations on record (pending) that were issued within the last 12 months, you may apply to have the violations re-issued.

如若在過去 12 個月內沒有違規記錄(或违规待定),我们可以申請重新發出違規。

以下是根据以往案例细分,需在进行 violations re-issued 之前解决的因素:

The building is not validly registered. 被委托建築物没有有效註冊登记。

There are false certifications within the past 1 year. 過去1年內有虛假證明。

The owner, managing agent, or subject building is the subject of pending HPD-related litigation. 業主、管理代理人或建築主体有和 HPD-住房保护与开发局的相關訴訟。

There is an unpaid emergency repair charge for repairs performed by or on behalf of the Department. HPD 部門或其代表部門曾负责執行被委托建筑的維修,未付清的緊急維修費用需要进行支付。

The building is in the Alternative Enforcement Program. 該建築屬於替代執法計劃。
